1. General Provisions
1.1. These Terms and Conditions (“T&C”) apply to purchases made through Pinkpara.com.
1.2. The seller (“Seller”) offers premium art prints that are custom-made for each customer.
1.3. The Seller reserves the right to modify these T&C at any time. Changes take effect upon publication on the website.
2. Purchase Terms and Custom Orders
2.1. The customer acknowledges that each order is a custom-made product.
2.2. No right of withdrawal, refund, or return applies, as each product is individually manufactured.
2.3. Orders are placed online using the payment methods provided by the Seller.
2.4. All sales are final. No refunds, exchanges, or chargebacks are allowed.
All sales are final. Due to the unique nature of each artwork, no refunds, exchanges, or chargebacks are allowed after purchase. By completing the transaction, the buyer agrees to these terms.
3. Prices and Payment Terms
3.1. All prices are in U.S. dollars (USD).
3.2. Accepted payment methods:
- Credit card payments (Visa, MasterCard, American Express)
- PayPal
- Apple Pay, Google Pay
- Klarna (if available)
3.3. All purchases include VAT based on German tax regulations.
3.4. For orders exceeding $15,000, a VIP contract may be offered to the buyer.
4. Shipping and Delivery
4.1. Since each order is custom-made, production and shipping times may vary.
- Production time: 14–30 days
- Shipping time:
- EU & USA: 7–14 business days
- Worldwide: 14–30 business days
4.2. Shipping is free, and costs are covered by the Seller.
4.3. Customs duties and import taxes are the buyer’s responsibility (e.g., USA, UK).
4.4. The buyer is responsible for providing accurate shipping details. The Seller is not liable for lost shipments due to incorrect addresses.
5. Liability and Warranty
5.1. As premium art prints are custom-made, slight variations between digital images and the final print may occur. This does not qualify as a defect.
5.2. The Seller is not responsible for:
- Shipping damages (this is the carrier’s responsibility).
- Customs delays.
- Incorrect shipping information provided by the buyer.
5.3. The buyer must inspect the package within 48 hours of receipt and report any issues.
The seller shall not be liable for any indirect, incidental, or consequential damages related to the purchase, shipping, or ownership of the artwork. All legal disputes shall be resolved amicably without court involvement.
6. Dispute Resolution and Legal Jurisdiction
6.1. The Seller is based in Germany, and all legal matters are subject to German law.
6.2. In case of a dispute, the parties agree to mediation before taking legal action.
In the event of any dispute, both parties agree to attempt mediation before any legal action is taken. If a resolution cannot be reached, arbitration shall be pursued rather than court litigation.
6.3. The Seller is not obligated to participate in alternative dispute resolution processes but will cooperate in resolving legal claims fairly.
7. Data Protection and Security
7.1. The Seller treats all customer data confidentially and does not share it with third parties except for order processing purposes (e.g., shipping companies).
7.2. Customer data is stored and processed securely using encrypted systems.
